Visa 13.5: Misrepresentation

What the cardholder is claiming

The cardholder says the terms or nature of what they bought were misrepresented at the time of purchase. This is the catch-all for trial offers that convert to subscriptions, free products with hidden charges, and sales copy that promised more than was delivered.

The evidence that actually wins

Bank analysts skim responses in minutes against a checklist for this exact code. Lead with the strongest fact; never make them dig.

  • A dated capture of the exact product page and checkout the customer saw, including where the recurring or full price was displayed
  • Click-through acceptance logs: timestamp, IP, and the specific terms version the customer accepted
  • Proof the negative-option or trial-conversion terms sat near the payment button, not buried in a linked policy
  • Delivery and usage records showing the customer received and used exactly what was described
  • Pre-dispute correspondence showing the customer understood the terms, for example a reminder email before a trial converted

The honest read

Issuers use 13.5 as the catch-all for negative-option billing and overpromising funnels, and they largely accept the cardholder's version unless you can show precisely what was on the screen at purchase. Undated screenshots of your current site prove nothing; the evidence has to tie to the purchase date. If your checkout buried the recurring terms, refund and rebuild the disclosure, because a pattern of these feeds Visa's integrity monitoring where the penalties dwarf the disputes. With dated disclosure proof and acceptance logs, this one is genuinely defensible.

Nobody can promise you a win; the cardholder's bank decides. What you control is submitting the strongest complete case your records support, on time. Our plain-language guarantees say exactly what that means.
